Some services may not be available in all countries or regions. The availability, scope, or deliverables of certain services may vary depending on local platform availability, directory networks, regulatory restrictions, or third-party service provider capabilities.
Clients purchasing services from outside the United States acknowledge that certain features, directories, advertising platforms, or integrations may differ from those available to U.S.-based businesses. Growth Reach Digital reserves the right to modify the scope of services, adjust deliverables, or decline service requests where services cannot reasonably be performed in a particular jurisdiction.
3. No Guaranteed Results
Digital marketing outcomes depend on many external factors including search engine algorithms, advertising platform policies, market competition, and client cooperation.
Growth Reach Digital does not guarantee:
- search engine rankings
- advertising performance
- website traffic levels
- lead volume
- revenue increases
All services are provided on a best-effort basis using professional judgment and industry practices.
4. Creative Work and Revisions
Marketing services often involve creative and strategic decisions that are inherently subjective.
Disagreement with creative direction, aesthetic preferences, or marketing strategy does not constitute service failure.
Depending on the service purchased, Growth Reach Digital may provide a reasonable number of revisions to deliverables. The number and scope of revisions may vary based on the service package and fulfillment process.
5. Client Responsibilities
Clients agree to:
- Provide accurate and complete information necessary to perform services
- Provide timely access to accounts, platforms, and systems when required
- Respond to requests for approvals, materials, or information in a timely manner
- Ensure their business practices comply with applicable laws and platform policies transmitted to
Failure to provide necessary access, approvals, or information may delay service delivery. Such delays do not constitute a breach of these Terms and do not entitle the client to refunds.
Growth Reach Digital may pause services if necessary information, access, or approvals are not provided.
6. Payments and Billing
Services may be offered as one-time purchases, prepaid consulting sessions, or recurring subscription services depending on the specific offering.
One-Time Services
Certain services are sold as fixed-price packages and must be paid in full before work begins.
Subscription Services
Some services may be offered on a recurring monthly basis and billed in advance.
Consulting Services
Consulting sessions and strategy services must be paid in advance unless otherwise agreed in writing.
Growth Reach Digital reserves the right to suspend services for overdue invoices or failed payments.
7. Advertising Spend
Advertising platform costs are separate from Growth Reach Digital service fees.
Budgets for platforms such as Google Ads, Meta Ads, TikTok Ads, or other advertising networks are typically billed directly by those platforms unless explicitly stated otherwise.
Growth Reach Digital is not responsible for billing practices, pricing changes, or policies of third-party advertising platforms.
8. Chargebacks and Payment Disputes
Clients agree to contact Growth Reach Digital to resolve any billing concerns before initiating a chargeback or payment dispute with their bank or payment provider.
If a client initiates a chargeback for services that were properly delivered or initiated in accordance with these Terms, Growth Reach Digital reserves the right to suspend or terminate services and pursue recovery of unpaid amounts, including any chargeback fees or administrative costs incurred.
9. Service Activation and Campaign Launch
Services typically require onboarding, research, and configuration before becoming active.
The service term begins once the campaign or service is launched and becomes operational. Preparation work performed prior to launch—including strategy development, account setup, research, and onboarding review—is considered part of the service delivery process.
Launch timelines may vary depending on the service purchased, client responsiveness, and required platform approvals.
Delays in providing required access, information, or approvals may delay campaign launch timelines.
10. Refunds and Cancellations
Clients may request a refund only if the request is made before work begins.
Work is considered to have begun once Growth Reach Digital initiates any internal preparation, research, strategic planning, onboarding review, account configuration, or service setup related to the purchased service.
Once work begins, services are non-refundable.
For subscription services, cancellation will apply to the next billing cycle and does not entitle the client to refunds for services already delivered.
11. Intellectual Property
Upon full payment, clients receive ownership of final deliverables created specifically for them, such as:
- website content
- graphics
- ad creatives
- written marketing content
- reports and campaign materials
Growth Reach Digital retains ownership of its internal tools, methodologies, templates, processes, and proprietary frameworks used to deliver services.
12. Portfolio Rights
Unless otherwise agreed in writing, Growth Reach Digital may reference completed work in its portfolio, case studies, or marketing materials.
This may include project descriptions, screenshots, or general performance metrics.
13. Third-Party Platforms
Marketing services frequently involve third-party platforms including but not limited to:
- Meta
- TikTok
- search engines
- directories and listings
- advertising networks
- analytics platforms
Accounts and assets on these platforms remain subject to the terms, policies, and ownership rules of those platforms.
Growth Reach Digital is not responsible for policy changes, algorithm changes, account suspensions, or other platform actions outside our control.
14. Acceptable Use
Clients may not use Growth Reach Digital services to promote or engage in:
- illegal activities
- fraudulent or deceptive marketing practices
- spam or unsolicited mass messaging
- copyright infringement
- malware or harmful software
- tactics that violate search engine or advertising platform policies
Growth Reach Digital reserves the right to refuse or terminate services if requested activities violate these Terms, applicable laws, platform policies, or professional standards.
Growth Reach Digital may also refuse or discontinue services at its sole discretion when necessary to protect the integrity of our business or compliance with applicable policies.
15. Termination
Growth Reach Digital may terminate or suspend services if:
- a client violates these Terms
- payment obligations are not met
- requested activities violate platform rules or applicable laws
- continued service would create legal or operational risk
Termination does not entitle the client to refunds for services already performed.

Growth Reach Digital’s total liability for any claim related to services shall not exceed the total fees paid by the client to Growth Reach Digital for services during the twelve (12) months preceding the claim.
18. Governing Law
These Terms are governed by the laws of the State of Texas, without regard to conflict-of-law principles.
19. Arbitration and Dispute Resolution
Any dispute arising from these Terms or from services provided by Growth Reach Digital shall be resolved through binding arbitration.
Arbitration shall be conducted in Harris County, Texas, in accordance with the rules of the American Arbitration Association (AAA) or a comparable arbitration provider.
20. Class Action Waiver
All disputes must be brought on an individual basis. Clients agree not to participate in any class action, collective action, or representative lawsuit against Growth Reach Digital.
21. Changes to These Terms
Growth Reach Digital may update these Terms from time to time.
The most current version will always be posted on our website with the effective date listed above.
Continued use of the website or services after updates constitutes acceptance of the revised Terms.
